KINDLY ENSURE THAT YOU CONTACT THE ADVANTAGE TOURS OFFICE 24 HRS BEFORE YOUR TRIP! Should there be rough seas and last minute cancellations by the boat operator, a full refund will be paid to the client if the client does not wish to re-schedule a time slot or date.

If you have made a booking, no last minute cancellations will be accepted whatsoever. NO people with osteoporosis, bad neck or back injuries, pregnant ladies or KIDS UNDER 12 YEARS will be accepted -

Adults are to take care and responsibility if they bring their children on this trip. The boat operator does not take responsibility for children whatsoever.

Precaution for sea sickness must be taken. If you carry any electronic equipment with you example ipad, cellphones, cameras etc, you will do so at your own risk and the boat operator / owners shall not take responsibility for this.

Please ensure that you are at the meeting spot 30 minutes prior to your whale watching experience as we need to prepare and brief you for the trip. No last minute arrivals will be welcomed as this delays the trip for the rest of the passengers and no refund will be paid out for last minute arrivals.

This service does not operate on Christmas Day and New Year.

CANCELLATION POLICY

This agreement cannot be cancelled except by mutual agreement between Advantage Tours and the client/guest/lodge. Advantage Tours shall be at liberty in its discretion to charge a cancellation fee or any percentage thereof at:

1. 5% of the tariff – on all cancellations as an administration fee;
2. 10% of the tariff – within two weeks prior to the departure/tour date;
3. 20% of the tariff – within one week prior to the departure/tour date;
4. 100% of the tariff - within 24 hours prior to the departure/tour date.

Whale Safaris is a business in the activity industry

Return and Refunds policy
The provision of goods and services by Whale Safaris is subject to availability. In cases of unavailability, Whale Safaris go to every endeavour to rebook/reschedule the service. If that is not possible, it will be considered to refund the client soon as possible.
Customer privacy policy
Whale Safaris shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

Payment options accepted
Payment may be made via Visa, MasterCard, credit cards for online bookings. Bank transfers or cash will only be accepted for direct bookings into the Whale Safaris bank account, the details of which will be provided on request
Credit card acquiring and security
Credit card transactions will be acquired for Whale Safaris via PayGate (Pty) Ltd who are the approved payment gateway. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
Customer details separate from card details
Customer details will be stored by Whale Safaris separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za
Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).
Responsibility
Whale Safari takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods
Country of domicile
This website is governed by the laws of South Africa and Whale Safari chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
Variation
Whale Safaris may, in its sole discretion, change this agreement or any part thereof at any time without notice.
